We unfortunately chose Assura as our health insurer. We signed the contract on 25.04.2012, and had a starting date of coverage of 01.05.2012. To my astonishment we recieve a bill from 01.04.2012!! How does this work you might ask? Simple really, "foriegners have to pay for the month in which they sign the contract"! What a load of bull! You telling me I sign a work contract and get paid for the month I sign it? Not much chance of that happening. I would strongly advise all foriegners to stay well clear of this company. I have still had no luck in getting this turned over, and I am not giving up. My contract says as of 01.05, and I will win.

But the coverage starts 01.05.2012. Why do you have to pay for a month in which you where not covered? I don't think this is legal at all. Hope comparis.ch has more insights to this question.

Ich kann zu wenig Englisch, um die Antwort in dieser Sprache zu formulieren, habe jedoch die Fragestellung verstanden. Zunächst ist festzuhalten, dass es sich bei der Grundversicherung um eine öffentlich-rechtliche Angelegenheit handelt, Sie also keinen Vertrag (contract) mit der Kasse abgeschlossen haben. Ich vermute, dass Sie kurz vor Versicherungsabschluss, spätestens im April, neu in die Schweiz zugezogen sind. Das Gesetz sieht vor, dass Sie sich ab dem Zeitpunkt versichern müssen, in welchem Sie in der Schweiz Wohnsitz nehmen. Ein Versicherungsbeginn per 1. Mai kommt somit schon mal nicht infrage. Stören kann höchstens die Tatsache, dass man Ihnen die Prämie für den ganzen Monat April in Rechnung gestellt hat. Tatsache ist jedoch, dass bei Zuzug oder auch Geburt oder Tod im Verlauf eines Monates die gesamte Monatsprämie geschuldet ist. (Fortsetzung folgt)

Es handelt sich hier um die sogenannte Unteilbarkeit der Prämie, für welche ich auch keine wirklich logische Erklärung wüsste, die von den Gerichte jedoch sanktioniert ist. Wenn es sich in der Tat um einen Neuzuzug in der Schweiz handelt, würden Sie in einem Rechtsstreit unweigerlich unterliegen.

Hallo Sirio, Danke für die kommentare. Ja, es handelt sich um ein zuzug in der Schweiz. Allerdings hat man ein 3 monat schornfrist, und man darf nur 1 mal krankenversichert sein. Wir können nachweisen das wir versichert waren im ausland, und bräuchten erst ab 01.05, da wir gesetzlich bis 28.05 im ausland versichert waren. Klar es ist nicht schön doppelt zu bezahlen, aber das müssen wir schon für Mai machen, aber nicht noch für April! Ich lege mich gerne an mit ein Anwalt von Assura an wenn es sein muss. Wir haben alles richtig getan, kann alles nachweisen das wir doppelt versichert waren in Mai, und das rechnung von April ist einfach abzocke von Assura!

Hi, I experienced same with more than 3 month I have had to pay to Avanex. They refer to the registration date of the person in switzerland. The opinion is - you have to pay - even you dt have a confirmation from the insurance about any contract Its against any international contracting-rules. u.dar

Member Sirio gave a very good explanation for this. In essence the points are ; by law you are required to have coverage from the first day you are in Switzerland, not from a future date like 01.05. Imagine that you had a bad accident in late April, how would you then be covered? Secondly, it is always done on a monthly basis, which in your case means retroactively from 01.04. It might seem unfair at first, but it is probably made so in order to simplify matters, not having to count days. What I would like to add is, that I believe the person or agent who made the contract with you, made a small mistake, as that person should have informed you about the month rule, and write the starting date as 01.04 (or 25.04), and tell you that you are covered the moment you sign the contract.

We had health insurance in a foriegn country that covered us till mid May 2012. We checked here and the law is that you can't be covered in 2 european countries at the same time. Why does it state on the contract the start date if it is irrelevant? Why not state the signature date is start date? I have no problem paying May in both countries, I had thought that is what would happen anyway, but to be billed for April, even though I stated 01.05.2012 on the application is a load of rubbish. By law in Switzerland they will also give you a 3 month tolerance period, providing you can prove you are insured somewhere else. We did this, and we can still prove it now. Therefore, I had coverage with one country till mid May, wanted the next one to start on 01.05.2012, but by being too early and signing the contract before the period of cover begins I am expected to pay for a service that I would never have used anyway. I personally think Assura are not being helpful here at all!!

If you have a double insurance für april it is legal. The swiss law says that you must have a swiss insurance for the month in which you arrive in switzerland. There are only a few options that you can still hold your old insurance. You have now 2 options. You can send Assura a confirmation that you are insured by an other european insurance company and i think Assura will change the beginning date. Or you can send a confirmation from Assura to your old insurance company to cancel this insurance to the end of march. The 3 month tolerance period is the time you have to choose an insurance. But the beginning date is always the first of the month of the arrival. After the 3 month the canton can dictate an insurance. Its called "Zwangszuweisung". The start date of your contract is in the moment the 1.4.2012. I think you mean the begining date in the offer was the 1.5.2012. But the customer service can change this date because of the entry in switzerland.
